Terms of use

Last updated: 21 October 2026

1. Publisher and purpose

1.1

The website accessible at otto-music.com, including all its pages, forms and embedded features (the “Website”), is published by OTTO Publishing Sàrl, a limited liability company incorporated under Swiss law, entered in the commercial register of the Canton of Geneva under number CHE-255.155.506, whose registered office is at Chemin de la Scie 4, 1290 Versoix, Switzerland (“OTTO”, “we”, “us” or “our”).

1.2

OTTO is an independent music publisher. It signs, develops and protects musical works, administers the rights of songwriters, composers and producers, including registrations, splits, statements and relations with collecting societies, seeks and negotiates synchronisation opportunities, and supports the long-term development of the writers it works with. The Website presents these activities and allows Users to contact OTTO, to send Licence Requests and to submit their music for evaluation.

1.3

These terms of use (the “Terms”) govern access to and use of the Website by any User. They set out the conditions of that access, the permitted and prohibited uses, the allocation of rights in the Content and in the Catalogue, the conditions applicable to Submissions, and the extent of our liability.

1.4

The Privacy Policy, the Cookie Policy and the Legal Notice published on the Website form an integral part of these Terms.

1.5

These Terms govern the use of the Website only. Any licence of a work of the Catalogue, and any publishing, administration, co-publishing, representation or other agreement between OTTO and a User, is governed exclusively by a separate written agreement, which prevails over these Terms in the event of conflict.

2. Acceptance and amendments

2.1

Accessing or using the Website entails acceptance of these Terms in the version in force at the date of that access. A User who does not accept them must refrain from using the Website.

2.2

The Website is intended for persons who have reached the age of majority and have the capacity to contract. A person under eighteen years of age may use the forms of the Website, and in particular the Join Form, only with the consent of his or her legal representative. Any agreement resulting from such contact requires the signature of that legal representative.

2.3

OTTO may amend these Terms at any time, in particular to reflect a development of the Website, of its activities or of the applicable law. The date of the version in force appears on the first page. The amended Terms apply to any access occurring after their publication on the Website. Previous versions are archived and available on request.

5. Permitted use

  7. use the Content or the Catalogue to sample, remix, synchronise, interpolate or otherwise create derivative works;

  9. introduce viruses, malware, ransomware, spyware or any other harmful code, or carry out any act liable to interrupt, overload or impair the operation of the Website;
  10. reverse engineer, decompile, disassemble or attempt to extract the source code of the Website, except to the extent permitted by mandatory law;

  15. collect personal data concerning other Users, the artists represented or the staff of OTTO;

OTTO expressly reserves all rights in the Content and in the Catalogue with respect to text and data mining, within the meaning of Article 4(3) of Directive (EU) 2019/790 and of any equivalent provision. It does not affect the exceptions which mandatory law grants for the purposes of scientific research.

6.3

Any breach of this article entitles OTTO to take the measures provided for in article 18 and to claim compensation for the damage suffered, including reasonable legal costs.

7. Intellectual property in the Website

7.1

The Website and its Content are protected by the Swiss Federal Act on Copyright and Related Rights, the Swiss Federal Act on the Protection of Trademarks and Indications of Source, the Swiss Federal Act against Unfair Competition and the applicable international treaties.

7.2

All Intellectual Property Rights in the Website and its Content belong to OTTO or to its licensors, including authors, artists, producers, photographers and designers. Access to the Website does not confer on the User any right in them other than the limited right of use granted in article 5.

7.3

The name and logo of OTTO, and any other sign used to identify its activities, are trademarks or distinctive signs of OTTO. No licence to use them is granted. otto-music.com is a domain name of OTTO and may not be used in a manner liable to cause confusion.

7.4

All rights not expressly granted in these Terms are reserved.

8. Musical works, recordings and licensing

8.1

The works of the Catalogue and the Recordings presented on the Website are subject to distinct rights: the rights of the authors and of their publisher in the Musical Works, including compositions and lyrics, on the one hand, and the rights of the performers and of the producers in the Recordings, on the other. OTTO may control all, part or none of the rights in the Recording of a work it publishes. All rights are reserved to their respective holders.

8.2

Any player, preview or excerpt made available on the Website is provided for listening and promotional purposes only. It does not constitute a licence and confers no right to download, reproduce, synchronise with images, adapt, arrange, translate, remix, sample, interpolate, publicly perform, broadcast or make available any Musical Work or Recording.

8.3

Any use of a work of the Catalogue requires a prior written licence. Depending on the type of use and on the territory, the rights are cleared with OTTO, with the competent collecting society, with the holder of the rights in the Recording, or with several of them. Licence Requests should be sent to contact@otto-music.com, stating the work concerned, the intended use, the media, the territory and the term. By way of indication:

  1. the synchronisation of a Musical Work with images, including in film, series, advertising, video games and online or social media video, is licensed by OTTO;
  2. adaptations, arrangements, translations of lyrics and printed or digital sheet music are licensed by OTTO;
  3. sampling and interpolation require the prior consent of OTTO for the Musical Work and of the holder of the rights in the Recording concerned;
  4. mechanical reproduction, public performance, broadcasting and making available are, to the extent they fall within collective management, licensed by SUISA or SACEM or by the competent collecting society in the territory concerned, with which the user must clear those rights directly.
8.4

A Licence Request constitutes an invitation to enter into negotiations. It creates no obligation for OTTO to grant a licence, and no licence arises from the mere sending, acknowledgement or examination of a request. A licence is formed only upon signature of a written agreement, or upon an express written confirmation by OTTO stating its scope, media, territory, term and fee.

8.5

The information published on the Website concerning the Catalogue, including credits, ownership shares and availability, is provided for information only and may change. It does not constitute a representation as to the ownership or availability of rights, which are confirmed only in the licence agreement.

9. Artist names, trademarks and press material

9.1

The names, stage names, likenesses, voices, signatures, logos and artwork of the artists, songwriters and producers presented on the Website are protected by their personality rights and, where applicable, by trademarks or other Intellectual Property Rights belonging to them or to OTTO.

9.2

They may not be used for advertising, merchandising or any other commercial purpose, nor in a manner suggesting a partnership, endorsement or affiliation that does not exist.

9.3

Press and media may reproduce the press material published in the news or press section of the Website, for the sole purpose of editorial coverage of the artists or projects concerned, provided that the material is not altered, cropped in a misleading manner or used out of context, and that it is credited as follows: “Property of OTTO Publishing”. Any other use requires the prior consent of OTTO, to be requested at contact@otto-music.com.

10. Notification of infringements

10.1

Any person who considers that Content published on the Website infringes his or her rights may notify OTTO at contact@otto-music.com. The notification should contain:

  1. the identity and contact details of the notifying person and, where applicable, of the person on whose behalf the notification is made;
  2. the identification of the work, recording or other subject matter concerned;
  3. the precise location (URL) of the disputed Content;
  4. the reasons for which the Content is considered unlawful, together with evidence of the rights invoked or of the authority to act;
  5. a statement that the information provided is accurate and complete.
10.2

OTTO examines notifications diligently. Where a claim appears justified, OTTO removes or disables access to the Content concerned and may inform the person who provided it. OTTO may decline to act on a notification that is incomplete, manifestly unfounded or abusive.

10.3

A person who sends a notification knowing it to be inaccurate may incur liability towards OTTO and towards the persons concerned.

11. Artist submissions

11.1

The Join Form allows songwriters, composers, producers and artists to submit their music to OTTO for evaluation. Each Submission is reviewed by members of the OTTO team, and not by automated means. OTTO endeavours to reply to every Submitter, but does not undertake to reply within a given time and is not required to state the grounds of a decision not to pursue a Submission.

11.2

By sending a Submission, the Submitter represents and warrants that:

  1. he or she is the author, performer or holder of the rights in the material submitted, or is duly authorised to submit it by all holders of rights, including any co-writers, featured artists and producers;
  2. the material does not infringe any third-party right, in particular through uncleared samples, interpolations or contributions, and does not contain unlawful content;
  3. the material is the result of human creative work and has not been generated, in whole or in substantial part, by an artificial intelligence system, and any use of such a system in its creation, including for production, mixing or mastering, has been disclosed in the Submission;
  4. the information provided, including credits, ownership shares and existing commitments, is accurate and complete;
  5. he or she is not bound by an exclusive publishing, recording, management or other commitment preventing discussions with OTTO, or has disclosed any such commitment in the Submission;
  6. where he or she is under eighteen years of age, he or she acts with the consent of his or her legal representative.
11.3

The Submitter grants OTTO a non-exclusive, free and non-transferable right, limited to the purpose of evaluating the Submission, to access, listen to, view and store the Submission and to share it internally and with its advisers bound by confidentiality. OTTO acquires no other right in the Musical Works or Recordings submitted and will not exploit them without a separate written agreement.

11.4

A Submission creates no partnership, no exclusivity and no publishing, administration, co-publishing, management or representation agreement. Any collaboration is formed only by a separate written agreement signed by OTTO and by the Submitter or his or her legal representative. Expressions of interest made by OTTO in the course of discussions do not constitute an offer.

11.5

OTTO receives a large number of Submissions and develops works and projects internally and with its writers. The Submitter acknowledges that works, ideas, themes, titles, styles or concepts similar to those of a Submission may be created independently of it. Ideas, styles and concepts as such are not protected by copyright, and such a similarity does not in itself give rise to any claim against OTTO. This does not affect any claim based on the actual use of protected material submitted.

11.6

Physical media and original materials sent to OTTO are not returned. The Submitter is responsible for keeping copies of the material submitted.

11.7

OTTO does not publish music generated by artificial intelligence. It may decline a Submission or end discussions at any time where it has reason to believe that the material does not comply with article 11.2(c).

11.8

The personal data contained in a Submission are processed in accordance with the Privacy Policy, which also states the period for which Submissions are retained.

12. Enquiries and communications

12.1

The User undertakes to provide accurate information when using the contact form or any other form of the Website, and not to use the forms for purposes other than those for which they are intended.

12.2

Messages sent through the contact form are not treated as confidential unless agreed otherwise in writing. Unreleased material should be sent only through the Join Form or through a channel agreed with OTTO.

12.3

Electronic communications are exposed to interception, spoofing and phishing. OTTO never requests a payment, banking details or login credentials in exchange for the evaluation of a Submission or the conclusion of an agreement. Any such request purporting to come from OTTO should be reported to contact@otto-music.com.

13. Website provided “as is”

13.1

The Website and its Content are provided “as is” and “as available”, for general information on OTTO and its activities. They do not constitute legal, financial or professional advice.

13.2

OTTO takes reasonable care to ensure that the information published is accurate and up to date, but gives no warranty, express or implied, as to its accuracy, completeness, timeliness or suitability for a particular purpose, nor that the Website will be free of errors, viruses or interruptions.

13.3

The User is responsible for protecting his or her own equipment and data, in particular by means of up-to-date security software.

14. Liability

14.1

To the extent permitted by law, OTTO excludes all liability for direct or indirect damage, including loss of data, loss of profit, loss of opportunity or damage to reputation, arising from access to, use of or inability to use the Website, from reliance on its Content, from the interruption, suspension or termination of the Website, or from the content of third-party websites and services.

14.2

To the extent permitted by law, OTTO also excludes all liability for the acts of its auxiliaries, including its hosting and technical providers.

14.3

Nothing in these Terms limits or excludes liability for damage caused intentionally or through gross negligence, liability for death or personal injury, or any other liability which cannot be limited or excluded under mandatory law.

14.4

OTTO is not liable for the relationships between Users and third parties, including third-party rights holders, collecting societies and providers of embedded content.

15. Indemnification

15.1

The User shall indemnify and hold harmless OTTO, its officers, employees, artists and licensors from any claim, loss, damage, fine or expense, including reasonable legal fees, arising from a breach by the User of these Terms, from any use of the Website contrary to them, or from the inaccuracy of the representations and warranties given in a Submission, in particular where a third party claims rights in the material submitted.

15.2

OTTO shall inform the User of any such claim and may conduct its own defence or take part in the defence conducted by the User.

16. Third-party websites and embedded content

16.1

The Website may contain links to third-party websites and embedded content provided by third parties, such as streaming players, video platforms and social media feeds. OTTO has no control over these services and assumes no responsibility for their content, availability, practices or terms.

16.2

The use of embedded content is subject to the terms of use and privacy policies of the provider concerned. Listening to a work through an embedded player does not constitute a licence from OTTO.

16.3

A link to the Website from a third-party website must not create confusion as to the origin of the Content or suggest an affiliation with OTTO, and must be removed at the request of OTTO.

17. Personal data and cookies

17.1

The processing of personal data carried out through the Website is described in the Privacy Policy. The technologies used to store or read information on the device of the User are described in the Cookie Policy.

18. Suspension and termination of access

18.1

OTTO may, without notice and without compensation, restrict, suspend or terminate the access of a User to all or part of the Website, block the IP addresses concerned, and reject or delete any message or Submission, in the event of a breach of these Terms, of a risk to the security of the Website, of its Users or of the Catalogue, or where required by law or by a competent authority.

18.2

Articles 6.3, 7, 8, 10.3, 11.3 to 11.7, 14, 15 and 21 survive any termination of access.

19. Force majeure

19.1

OTTO is not liable for any failure or delay resulting from an event beyond its reasonable control, including a failure of the electronic communication networks, a cyberattack, a failure of a hosting or infrastructure provider, an epidemic, a natural event or an act of a public authority.

20. General provisions

20.1

These Terms, together with the documents referred to in article 1.4, constitute the entire agreement between the User and OTTO with respect to the use of the Website.

20.2

If any provision of these Terms is held invalid or unenforceable, the remaining provisions remain in force, and the invalid provision is replaced by a valid provision whose effect comes as close as possible to that intended.

20.3

The failure of OTTO to enforce a provision of these Terms does not constitute a waiver of its right to do so.

20.4

The User may not assign or transfer any right or obligation under these Terms. OTTO may assign these Terms to any entity succeeding to all or part of its activities.

20.5

These Terms are drafted in English. Where they are translated, the English version prevails.

20.6

Notices to OTTO are validly given by email to contact@otto-music.com or by post to its registered office.

21. Governing law and jurisdiction

21.1

These Terms and any dispute arising out of or in connection with them, including their conclusion, validity, interpretation and performance, are governed by Swiss law, to the exclusion of its rules on conflict of laws.

21.2

The ordinary courts of the Canton of Geneva, Switzerland, have exclusive jurisdiction, subject to an appeal to the Swiss Federal Supreme Court. OTTO may also bring proceedings before the courts of the domicile of the User.

21.3

Mandatory provisions on jurisdiction and applicable law protecting consumers in their State of residence are reserved.

6. Sensitive data and minors

We do not request any data deserving special protection within the meaning of Article 5(c) FADP or Article 9 GDPR, such as data relating to health, religious, philosophical or political views, ethnic origin or sexual orientation. Lyrics, biographies or artistic material may nonetheless reveal such information. We process it only as part of the artistic material evaluated and do not record it separately in our evaluation notes. Where that material has been manifestly made public by you, the processing relies on Article 9(2)(e) GDPR.

The Website is not directed at children. A person under eighteen years of age may send us a Submission only with the consent of his or her legal representative. If we learn that we have received the data of a child under sixteen years of age without that consent, we delete them.

7. Automated decisions and artificial intelligence

Every Submission is listened to and reviewed by members of our team. We do not use algorithms or automated tools to evaluate, rank or select Submissions, and we do not take decisions based solely on automated processing which produce legal effects concerning you or significantly affect you, within the meaning of Article 21 FADP and Article 22 GDPR.

Google reCAPTCHA automatically assesses whether a form is being completed by a human or by a robot. This assessment serves only to protect the forms. It does not concern the content of your message or Submission and is not a decision concerning you within the meaning of the provisions above.

8. Who receives your data

  8. Right to contact the supervisory authority: you may report a processing to the Federal Data Protection and Information Commissioner, Feldeggweg 1, 3003 Bern (Article 49 FADP), or, if you reside or work in the European Economic Area, lodge a complaint with the supervisory authority of your place of residence or work (Article 77 GDPR).

Exercising your rights is free of charge, save where a request is manifestly unfounded, excessive or requires a disproportionate effort, in which case we may request a contribution to costs within the limits set by law.

Your rights may be restricted where the law so provides, in particular where we are under a legal obligation to retain the data concerned, or where compliance would disclose the personal data of third parties, such as co-writers or other artists.

14. Cookies and similar technologies

The Website itself does not set any cookie. Cookies are set only by Google Analytics 4, after you have given your consent, and by Google reCAPTCHA on the pages containing a form, after you have given your consent. The Website also stores in your browser your display preference on the Artists page and your cookie choices. The technologies used, their purposes, their duration and the means of managing your choices are described in our Cookie Policy.

15. Changes to this Policy and contact

We may amend this Policy to reflect changes to our activities, to our providers or to the applicable law. The date of the version in force appears on the first page. Where a change is material, in particular a new purpose or a new category of recipient, we inform you in advance on the Website and, where we hold your contact details in connection with an ongoing Submission or relationship, by email. Previous versions are archived and available on request.

Cookie policy

Last updated: 27 October 2026

1. Purpose and scope

This cookie policy (the “Cookie Policy”) explains how OTTO Publishing Sàrl, Chemin de la Scie 4, 1290 Versoix, Switzerland (“OTTO”, “we”, “us” or “our”), uses cookies and similar technologies on the website accessible at otto-music.com (the “Website”), and how you can manage your choices.

The Website itself does not set any cookie, whether for its operation, for advertising or for tracking across websites. The only cookies present on your device as a result of your visit are set by two services provided by Google: Google Analytics 4, which measures the audience of the Website, and Google reCAPTCHA, which protects our forms against robots. The Website also uses the storage of your browser to remember your display preference and your cookie choices.

The processing of personal data collected through these technologies is further described in our Privacy Policy.

2. What cookies and similar technologies are

For convenience, all the technologies described below are referred to in this Cookie Policy as “cookies”.

TermDescription
CookieA small text file stored on your device by your browser when you visit a website, which allows information to be recognised or retrieved during that visit or a later one.
First-party and third-party cookiesFirst-party cookies are set by the Website itself. Third-party cookies are set by another provider, in the present case Google.
Session and persistent cookiesSession cookies are deleted when you close your browser. Persistent cookies remain on your device for the period stated in section 5, unless you delete them earlier.
Local storageA storage area of your browser that allows a website to keep information on your device without an expiry date, until you clear the data of your browser.
ScriptA program executed by your browser to provide a feature, such as the measurement of the audience or the protection of a form.

3. Legal framework

In Switzerland, the storage and reading of information on your device are governed by Article 45c(b) of the Federal Telecommunications Act, which requires that you be informed of their use and of their purpose and that you be able to refuse them, and by the Federal Act on Data Protection.

For visitors located in the European Economic Area, the national laws implementing Article 5(3) of Directive 2002/58/EC (the ePrivacy Directive) and the GDPR require your prior consent for any storage or reading of information that is not strictly necessary for the provision of the service you have requested.

We apply the same standard to all visitors, wherever they are located: Google Analytics 4 and Google reCAPTCHA are loaded only after you have given your consent.

4. Categories of cookies

Strictly necessary. The record of your cookie choices is kept in your browser so that the banner is not displayed again on each page. It is set without your consent and cannot be disabled through our consent tool.

Preferences. When you choose to display the Artists page as a grid or as a list, your choice is kept in the local storage of your browser. This entry contains no personal data, is never transmitted to our server and is created only at your request.

Statistics. Google Analytics 4 measures the audience of the Website and the way in which it is used, in order to improve its content and operation. Its script and cookies are loaded only after you have given your consent.

Form protection. Google reCAPTCHA protects the contact form and the “Join” form against automated sending. It is loaded only on the pages containing a form (home page, contact page and “Join” page) and only after you have given your consent. If you refuse it, the forms remain available and are protected by an invisible control field and by a limit of three submissions per IP address every ten minutes.

Advertising and marketing. None are used on the Website.

5. Cookies used on the Website

Your consent, or your refusal, is stored for twelve months, after which you will be asked again.

6. Google services and other third parties

Google Analytics 4 and Google reCAPTCHA are provided by Google Ireland Limited, Gordon House, Barrow Street, Dublin 4, Ireland. Their scripts are loaded from the servers of Google. Google may transfer the data collected to Google LLC in the United States, which is certified under the EU-U.S. Data Privacy Framework and its Swiss-U.S. extension.

Once you have given your consent, Google Analytics 4 transmits to Google data on your use of the Website, associated with the random identifier stored in its cookies. According to Google, Google Analytics 4 does not log or store IP addresses. We have set the retention of event data in Google Analytics 4 at fourteen months, and we only access aggregated statistics.

To determine whether a form is being completed by a human, Google reCAPTCHA transmits to Google in particular your IP address, information on your browser and device, and data on your behaviour on the page. The use of Google reCAPTCHA is subject to the Google Privacy Policy and the Google Terms of Service.

All other resources of the Website, including fonts, animation libraries, images and videos, are served from our own hosting, without any call to a third party. The Website contains no embedded content from third parties. The links to Instagram, TikTok, Facebook, Spotify and YouTube are simple links, and no data are transmitted to these platforms until you click on them.

7. Managing your choices

Through our consent tool. On your first visit, a banner allows you to accept all non-essential cookies, to refuse them all, or to choose by category. Refusing is as simple as accepting, and the Website remains accessible if you refuse. You may change or withdraw your choice at any time through the “Cookie settings” link at the bottom of each page. Withdrawing your consent does not affect the lawfulness of the processing carried out before the withdrawal.

Through your browser. You may also configure your browser to refuse cookies, to be notified before a cookie is set, or to delete the cookies and the local storage data already stored. The relevant options are generally found in the privacy or security settings of the browser. Google also offers a browser add-on that prevents the transmission of data to Google Analytics.

If you delete the data of your browser, your choices are lost and the banner is displayed again on your next visit.

8. Your rights

Where the information collected through cookies constitutes personal data, you have the rights described in our Privacy Policy, in particular the rights of access, rectification, erasure and objection, and the right to contact the competent supervisory authority.

9. Changes to this Cookie Policy and contact

We may amend this Cookie Policy to reflect changes in the technologies used on the Website or in the applicable law. The date of the version in force appears on the first page. Where a change requires your consent, we will ask for it again through our consent tool.
